Welcome to Byengineers. These Terms & Conditions (“Terms”) govern your access to and use of the Byengineers platform and services (the “Platform”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About Byengineers
Byengineers is a specialized marketplace that connects clients with verified professional engineers across disciplines such as structural, civil, electrical, and mechanical engineering. We provide the technology and tools that let clients and engineers connect, transact, and communicate; we are not the provider of the engineering services themselves.
2. Eligibility & accounts
- You must be at least 18 years old and able to enter into a binding agreement.
- You agree to provide accurate information and to keep your account details up to date.
- You are responsible for all activity that happens under your account and for keeping your password secure.
- Engineers may be required to complete identity verification before offering services.
3. Roles & responsibilities
Clients are responsible for clearly describing their requirements, paying for orders, and reviewing delivered work in good faith. Engineers are responsible for accurately describing their services, delivering work that meets the agreed scope and professional standards, and communicating promptly. Both parties agree to act honestly and respectfully.
4. Services, orders & packages
Engineers list services in up to three packages (Basic, Standard, Premium), each with a fixed price, delivery time, and scope. When a client purchases a package, a binding order is created between the client and the engineer. Byengineers facilitates the order but is not a party to the underlying engineering work.
5. Payments, wallet & withdrawals
- Clients pay securely by card at checkout. Funds are held by Byengineers and released to the engineer only after the client confirms completion.
- When an order is completed, the order amount is credited to the engineer’s wallet.
- Engineers may request withdrawals by bank transfer or PayPal, subject to review and any applicable platform service fee.
- You are responsible for any taxes that apply to your earnings or purchases.
6. Company Guarantee
For eligible orders, clients may add the optional Company Guarantee, under which Byengineers reviews the engineer’s deliverable against the agreed scope before delivery. The guarantee is described on the Pricing page and is provided on a best-efforts basis; it does not replace the engineer’s professional responsibility for their work.
7. Cancellations & refunds
Cancellations and refunds are governed by our Cancellation Policy and Refund Policy, which form part of these Terms.
8. Reviews & conduct
Only clients who have completed an order may leave a review, and reviews must be honest and based on genuine experience. You agree not to post unlawful, misleading, abusive, or infringing content, and not to attempt to circumvent the Platform’s payment or messaging systems.
9. Intellectual property & deliverables
Ownership of work delivered through an order is as agreed between the client and the engineer for that order; unless stated otherwise, rights in a paid deliverable transfer to the client upon completion. The Byengineers name, logo, and Platform are owned by Byengineers and may not be used without permission.
10. Prohibited use
- Using the Platform for any unlawful, fraudulent, or harmful purpose.
- Misrepresenting your identity, qualifications, or the services you offer.
- Taking transactions off-platform to avoid fees or protections.
- Attempting to disrupt, reverse-engineer, or gain unauthorized access to the Platform.
11. Disclaimers & limitation of liability
The Platform is provided “as is.” While we work to maintain a trustworthy marketplace, Byengineers does not guarantee the outcome of any engineering engagement and is not liable for the acts, omissions, or work quality of clients or engineers. To the maximum extent permitted by law, Byengineers’ total liability arising from your use of the Platform is limited to the amount of fees we received in connection with the relevant order.
12. Indemnity
You agree to indemnify and hold harmless Byengineers from any claims, damages, or expenses arising out of your use of the Platform, your content, or your breach of these Terms.
13. Suspension & termination
We may suspend or close accounts that violate these Terms or that put other users, the Platform, or third parties at risk. You may close your account at any time, subject to completing any open orders and obligations.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the date above, and your continued use of the Platform after changes take effect means you accept them.
15. Governing law
These Terms are governed by the laws of [the Hashemite Kingdom of Jordan / your jurisdiction — to confirm], and any disputes will be subject to the courts of that jurisdiction.
